Brian Rich, partner, had his “Avoiding Potential Litigation Issues and Defending Banks in an Age of Increased Scrutiny” article published by the American Bankers Association’s ABA Banking Journal. The article provides best practices for banks to minimize litigation risks from the onset and how to address them when they arise:

  • Common sense is not that common.
  • Treat your legal counsel as counsel.
  • No two banks are the same.
  • Communication is key.
  • Be boring, but be human.
  • Identify the issues.
  • Less may not be more.
  • Admit mistakes. The cover-up often really is worse than the “crime.”
